For services rendered in this application สินเชื่อฉับไว (hereinafter referred to as “Application”), Magastar Speed Company Limited (hereinafter referred to as “we” or “Company”), cares about the privacy of our customers, thus, we publish this Privacy Policy (“Policy”) to inform our customers of our Policy in relation to the collection, use and disclosure of your personal data, along with types of data to be collected, used or disclosed and purpose of such actions, together with methods of storage of your personal data. The Policy also set out your rights towards your data collected by us.

Unless there exist other legal grounds allowing the Company to collect, use or disclose your personal data without your prior consent, only with your express permission will our Company collect, use or disclose your personal data to the extent of your consent.

1. How we collect your personal data

We only collect your personal data where it is necessary or there is a lawful basis for collecting it. This includes where we collect your personal data (1) based on the legitimate grounds of legal obligation and performance of contract made between you and us, (2) our legitimate interests, or (3) performance under your consent and other lawful basis.

By using this Application, you have given your express consent to us for collecting your personal data in the following ways:

1.1 Basic personal information provided by users

When register as a user, it is necessary that you provide the following information to us so that we can provide service to you via the Application: (1) name and family name, (2) date of birth, (3) gender, (4) residential address, (5) telephone number, (6) emergency contacts, (7) ID information, (8) beneficiary's bank account information, and (9) biometric information.

Please note that by registration, you agree to give such personal data to us so that we can provide services to you via the Application. Failure to give such information to us may result in our inability to provide you with the some or whole part of the services.

1.2 Information collected during use of service

We collect information about the devices you use to access our services. The information and permissions we collect includes:

1.2.1 LOCATION

We collect your geo-location information when the Application is running in the foreground so as to auto-fill your address data. We however endeavor to cease collection of your geo-location information when the Application is not in use by you. You can always choose to disable the geo-location tracking information on your mobile device temporarily.

We will never share this data with third parties, other than as expressly permitted by you or where we are required to do so by applicable laws, orders rendered by courts, state authorities or any order or requirement of similar nature which have lawful basis that the Company must comply with.

1.2.2 OTHER DEVICE INFORMATION

When you utilize this Application, our server automatically records certain device information, which is sent by your mobile device. The other device information includes device brand, model, operating system version, device unique identifier, device network environment, WiFi, device status, identification international mobile device, international mobile subscriber identification, application software information, device memory information. The authorization to access this information helps us to identify your user portrait and preferences and to recommend suitable credit products.

1.2.3 APPLICATION INSTALLED ON YOUR DEVICE

We provide financial services through the Application and it is our legal obligation to prevent frauds, money-laundering and other financial-related crime. In order for us to do so and procure safety of your fund and accounts, it is necessary for us to collect the information in relation to applications installed in your devices so that we are able to monitor risks which may arise from your mobile device behavior.

1.2.4 CALENDAR

The authorization to access your calendar is necessary for us to remind you of the due date of the loan repayment.

1.2.5 CAMERA

Please be informed that as the Application providing financial services, the Know Your Customer (KYC) policy is necessary for us to comply with. We require the camera information permission to provide you an easy/smooth experience and to enable you to take photos of your face and KYC documents along with other requisite documents and upload the same in the Application during your loan services journey through the Application.

2. VALIDITY AND ACCURACY OF INFORMATION SUBMITTED

2.1 Submission of True and Accurate Information

You must submit to us information including personal data which is true and accurate and not misleading, and you must keep it up to date and inform us of changes as soon as practicable. We reserve the right to request for documentation to verify information provided by you.

2.2 Voluntary Submission of Personal Data

We will only be able to collect your personal data if you voluntarily submit the information to us. Some of the data required to be submit by you is necessary for us to be able to provide services to you via the Application. If you choose not to submit your personal data to us or subsequently withdraw your consent to our use of your personal data, we may not be able to provide you with some or all of the services available through the Application.

3. Disclosure of your personal data to third parties

The Company will disclose your personal data to third parties only in the following cases where the disclosure shall be in accordance with the provisions under the Personal Data Protection Act B.E. 2562 (2019) (the “PDPA”):

· Disclosure to the Company’s affiliates, business partners and/or third parties that are related to the Company, including directors, executives, employees, staffs, representatives, advisors of the Company or the Company’s affiliates or business partners.

· Disclosure to third-party cooperative institutions, including lenders, payment partners, post-loan partners, third-party verification service providers, messages service providers, call-out service partners. This is in order to help you successfully apply for the loan.

· Disclosure to enable you to trade and/or use services that you desire.

· Disclosure to the Credit Bureau (a type of credit reporting agency).

· Disclosure to polices, state attorney, courts or any state authorities to comply with requirements under the applicable laws, regulations, or orders rendered by them or as per required under legal investigation or legal proceedings;

4. PURPOSE OF USE, COLLECTION AND DISCLOSURE OF PERSONAL DATA (“PROCESSING”)

We will process your personal data primarily as necessary to provide you with a service or product you have requested. In addition, we may process your personal data where there exist other legal grounds, including when we are required to process your personal data to comply with legal obligation or a public duty required for us by law, performance of obligation under contract made between you and us, our legitimate interests, or performance under your consent and other lawful basis.

Your personal data shall be processed on the following grounds and for the following purposes:

4.1 Legal Obligation of the Company

The Company may be required to process your personal data for the purposes of legal compliance under the applicable laws and regulations of relevant state authorities supervising the Company, including but not limited to:

a) To comply with the PDPA;

b) To comply with relevant laws (including financial institution law, anti money-laundering law, anti-terrorist financial support law, accounting law, tax law or other law the Company is required to comply with). In addition, to proceed with user identification, to examine records and credit of Users, to proceed with KYC process, to conduct customers due diligence, and other examination, e.g., examination by using information from public data base provided by authorized state authorities and other relevant legal process which the Company is required to do so; and

c) To comply with regulations or order made by state authorities e.g., court order.

4.2 Performance of Contract

The Company shall have to process your personal data in order to fulfil obligation under contract made between you and the Company e.g. to provide you with the services as you may request. The processing of your personal data shall include, but not limited to, these following purposes:

· to identify Users;

· to contact Users in relation to their registered account/s or requested information;

· to process registration of account/s and to determine or assist in determination of decisions as part of screening of the investors, borrowers, registrations or loan applications, and/or to deliver our products and/or services to the User and any directly related purposes;

· to facilitate loan processing from Application, review, monitoring, payment, collection and other remedial measures;

· to initiate and maintain correspondence with the User via electronic mail (e-mail), SMS (short messaging service), in-app message/communication, registered mail, phone calls or field visits;

· to resolve complaints and handling requests and inquiries made by the Users; and

· to perform Users location search;

4.3 The Company’s Legitimate Interests

In some cases, the Company may need to process your personal data for the purpose of the Company’s legitimate interests, including but not limited to the followings:

· to maintain internal records regarding relevant information about the services used by Users including loan obtained by Users, loan repayment, security for the Company to facilitate services to the Users;

· to conduct background check and identity verification, including KYC process;

· to monitor, detect, analyze and prevent any commission of fraud or other related-financial crime;

· to perform research on data to conduct investigations relating to disputes, payment, suspected illegal activities or fraud;

· to develop, enhance and maintain a risk assessment process and model, offline and online;

· to develop and generate a credit score, credit model and user model;

· to facilitate and as may be required as part of any financing or capital raising activity (i.e. obtaining loans, credit facility, mortgage, assignment, assignment as a form of security or mortgage of loans);

· to monitor or record phone calls and customer-facing interactions for quality assurance, employee training and performance evaluation and identity verification purposes;

· to execute, monitor, manage and analyse the Application and to develop, enhance, and upgrade the features, functions, products and services in the Application, including promotions, loyalty and reward programs;

· to conduct market research to enable the Application to understand and determine customer location, preferences and demographics to develop special offers, products or marketing programs in relation to products and services, and to improve (including. customized offers and products) such products and services;

· to facilitate business asset transactions (which may extend to any mergers, acquisitions or asset sales) of the Company;

· for any other legal and/or regulatory purposes (including but not limited to obtaining legal advice and dispute resolution) and to carry out all mandatory administrative, operational and legal duties

4.4 Your Consent

In some cases, the Company may process your personal data as for your consent allowing us to do so for your own interests and/or for the Company to be able to provide your services suitable for your needs, including but not limited to these following purposes:

· Where it is necessary to process your sensitive personal data (e.g., usage of photograph of your ID card which presents your sensitive personal data i.e., religious and/or blood type and your criminal record in order to conduct KYC process);

· to market and offering new, related or complementary products and services to the User;

· to carry out marketing and promotions initiatives relating to the Company, local affiliates of the Company, the Company’s partners, and other Company’s products and services, whether by electronic means, by email and post, or by telephone, SMS or social media, or by sending newsletters (for example, for the Users to be updated on new products or features and to publicize events, contests, demonstrations, loyalty programmes, and other activities organized by the company), also by using automated means. Such communications will relate to products and services of the financial products, services and the like;

· to enroll/participate the user in group credit and/or life insurance, credit risk analysis, credit investigation, credit scoring and credit collection on the User;

· Transfer of your personal data and sensitive personal data to foreign countries which do not have sufficient standard on personal data protection (except in the case where the provisions under the PDPA allow the Company to do so based on other legal ground or without having to obtain consent from you as the data subject).

4.5 Other legal ground

· to provide information to external parties such as government agencies, and other institutions as part of scientific research and/or study;

5. STORAGE OF PERSOANL DATA

All of the personal data collected by the Company will not be retained permanently. The Company will keep your personal data only while you remain the customers of the Company or as long as is required by law or necessary to allow the purpose for which the data is collected and used. Once you cease to use the services provided through the Application or once the data is not necessary for the purpose for which the data is collected and used or once the storage of your personal data exceeds the retention period, the Company will delete your personal data from the Company’s database and/or destroy your personal data, as may be necessary.

The Company will also retain your personal data for a period in accordance with legal prescription or relevant period specified under relevant laws. If you need to delete your data immediately, you shall notify our customer service center via email: Help@cherrybk.com.

6. BIOMETRIC INFORMATION

6.1 We collect your facial data by requesting you taking a live face photo during the facial recognition process and will use and process it for the following purposes:

· to verify your identification;

· to prove the loan is applied by yourself, at the time of loan application and any other time other that, including when there is a dispute regarding the loan; and

· to prevent loan fraud.

6.2 This information will be uploaded to our server www.cherrybk.com. We will hold your face photo until you fully repay the loan and other amount payable, if any, or such longer period as may be required by applicable law, e.g., applicable statute of limitations, etc. If you need to delete your face photo data immediately, you shall notify us via email Help@cherrybk.com.

6.3 We will never share this data with third parties, other than as expressly permitted by you or where we are required to do so by applicable laws, orders rendered by courts, state authorities or any order or requirement of similar nature which have lawful basis that the Company must comply with. These courts and/or authorities will retain your data for the duration mandated by applicable law.

7. SECURITY OF PERSONAL DATA

7.1 The Company values personal data collected, used, retained and stored through the Application. The Company therefore has adopted technical, organizational and physical measures to protect your personal data in the Application or database of the Company. All the collected data will be stored at www.cherrybk.com.

7.2 We understand the importance of keeping your information safe and secure. We make reasonable efforts to protect your personal information and ensure the security of our systems. To protect your personal information from unauthorized access and use, we use security measures that comply with applicable laws. The Company also uses the following advanced security technologies to protect your personal data:

· Intrusion detection: a software system used to detect and block unauthorized hacker attacks. The Company uses an efficient system and will update such system on a regular basis.

· Firewall: a software system that allows only employees authorized by our company to access your personal data. The Company applies a dual firewall protection system.

· Virus scan: The Company regularly installs efficient anti-virus software in the Company’s system and specifically installs virus scanning software on the server.

· Secured socket layer: an encryption technology used to access data to prevent eavesdropping during transmission over the Internet. By using this technology, the person who intends to intercept the data or hacker cannot understand the meaning of the captured data. This technology can also be used to verify the existence of a company’s website, which uses 128-bit SSL (SSL.1 for data transmission).

· Data encryption: used for extremely sensitive data. The Company applies a strict security measure. Before importing the data into the Company’s computer database, it uses a complex algorithm for encryption, therefore no one, even the Company’s employees will know any such sensitive data.

· Cookies: a small file in a computer that can temporarily store important information on the computer to facilitate telecommunication. Our company attaches great importance to your privacy. Therefore, please use Cookies with caution. However, if Cookies are required, our company will carefully consider and pay attention to your safety and privacy first.

· Auto log-off: After finishing the transactions by using our services, please remember to log off. If you forget to log off, the system will automatically log off during a reasonable time period for your safety concern.

7.3 Although we make good faith efforts to store the information collected in the Application in a secure operating environment that is not available to the public, we cannot guarantee the absolute security of that information during its transmission or its storage on our system. Further, while we attempt to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will prevent third-party “hackers” from illegal obtaining access to this information. We do not warrant or represent that your information will be protected against, loss, misuse, or alteration by third parties.

8. USERS OBLIGATIONS AND RIGHTS OF THE COMPANY

You agree to inform us promptly, and in any event, within 14 calendar days, in writing if there are any changes to your information supplied to us from time to time, and to respond promptly to any request from us,

8.1 Where:

8.1.1 you fail to provide promptly any user information or personal data that we reasonably requested;

8.1.2 you withhold or withdraw any consents that we may need to process, transfer or disclose Personal Data for the purposes of used disclosed above in this Privacy Policy (except for purposes connected with marketing or promoting products and services to you); and/or

8.1.3 we have, or a member of our company has, suspicions regarding financial crime or an associated risk.

8.2 The Company may:

8.2.1 be unable to provide new, or continue to provide all or part of the services to you and reserve the right to terminate our relationship with you;

8.2.2 take actions necessary for us or a member of the company to meet the compliance or regulatory obligations; and/or

8.2.3 suspend, transfer or close your account(s) where permitted under local laws.

9. YOUR RIGHTS TOWARD PRIVACY

The PDPA provides you with certain rights with respect to your personal information where you may exercise those rights through the Company’s channels specify in this Policy. The rights include:

9.1 Right to access your personal data and to make copy of your personal data which is in possession of the Company

You may request the Company to give you access to your personal data and/or make copy of your personal data which are in possession of the Company, save for when your request may affect or cause damages other person’s rights where the Company may reject your request. The Company may also reject your request if there exist legal ground or pursuant to orders made by court or other state authorities.

9.2 Right to withdraw your consent

You have the right to withdraw your consent with respect to your personal data given to the Company at any time you desire, except in circumstances where the withdrawal of consent is not doable. The process for the withdrawal shall be as specified by the Company. In this regard, the withdrawal of your consent shall not affect any collection, usage or disclosure of personal data to which you have previously given consent. The withdrawal shall not also affect our provision of services, except for those requiring processing of your personal data that your consent is required.

9.3 Right to revise and/or delete the personal data in possession of the Company

You have the right to request the Company to revise or delete and/or destroy your personal data which are in possession of the Company or request the Company to make the personal data become anonymous data which cannot identify the data subject, unless the conservation of the said data is mandatory by laws and regulations, without retroactive effects. The revision, deletion and anonymization do not imply the impossibility of fulfilling obligation derived from a current legal relationship between you and the Company or when it comes to non-necessary purposes.

9.4 Right to request the Company to cease using your personal data

You have the right to request the Company to restrain from using your personal data, but not to delete or destroy your personal data from the Company’s database. For example, in case you wish the Company to retain your personal data so that you may use the data for legal proceedings, but you no longer want the Company to utilize your data, you may request the Company to restrain from using your personal data.

9.5 Right to object the collection, usage or disclosure of your personal data by the Company

You have the right to object the collection, usage or disclosure of your personal data by the Company where the Company conduct such action based on the ground of the Company’s legitimate interests or for the purpose of direct marketing, or for scientific, historical, or statistic research, save for where there exists legal ground that the Company may reject your request.

9.6 Right to request for receiving or transferring your personal data

You have the right to receive your personal data from the Company where the Company is able to arrange such personal data to be in the format which is readable or commonly used by ways of automatic tools or equipment and can be used or disclosed by automated means. You also have the right to request the Company to send or transfer the personal data in such formats to other person or to request to directly obtain the personal data in such formats that the Company sends or transfers to the other person, unless it is impossible to do so because of technical circumstances or where there exits legal ground for the Company to reject the request.

9.7 Right to make complaint

You have the right to file complaint to the Data Protection Officer of the Company. You also have the right to file complain to the Personal Data Protection Committee or the Office of Personal Data Protection Committee in case you found that the Company does not comply with the PDPA

10. MODIFICATION

This Policy may be updated from time to time and shall continue to remain in effect unless otherwise amended. If this Policy is changed, those changes will be posted in the Application. The change will be effective when posted. Users availing services and/or visitors to the Application are advised to check the Application on a regular basis to remain aware of the policies and practices of how information is collected and used.

If significant changes to this Policy will affect certain Personal Data, the Application shall notify the Users through the email address provided or by posting a public notice in the Application.

The foregoing consents and authorizations shall continue for the duration of, and shall survive the termination of any loan agreement(s) signed by the borrower, or any other transactions, dealings, arrangements and accounts which borrower may have with, or avail from, the Application and the lender through services and/or the Application.

เราจะเก็บรวบรวมข้อมูลส่วนบุคคลของท่านเฉพาะในกรณีที่มีความจำเป็นหรือมีเหตุตามกฎหมายให้ดำเนินการ ซึ่งรวมถึง การเก็บรวบรวมข้อมูลส่วนบุคคล (1) เนื่องจากเป็นการจำเป็นเพื่อการให้บริการแก่ท่านภายใต้แอปพลิเคชั่นตามที่ท่านร้องขอหรือตามสัญญาที่ท่านทำไว้กับริษัท (2) เพื่อประโยชน์โดยชอบด้วยกฎหมายของบริษัทฯ หรือ (3) การเก็บรวบรวมตามความยินยอมที่ท่านให้ไว้โดยชัดแจ้งแก่บริษัท หรือเหตุโดยชอบด้วยกฎหมายอื่นใด

การที่ท่านใช้บริการภายใต้แอปพลิเคชั่น ถือเป็นการที่ท่านให้ความยินยอมโดยชัดแจ้งแก่บริษัทฯ สำหรับการเก็บรวบรวมข้อมูลส่วนบุคคลของท่านด้วยวิธีการดังต่อไปนี้:

1.1 ข้อมูลส่วนบุคคลทั่วไปเกี่ยวกับท่านในฐานะผู้ใช้บริการ

เมื่อท่านสมัครเป็นผู้ใช้บริการแอปพลิเคชั่น ท่านรับราบว่าบริษัทฯ มีความจำเป็นต้องได้รับข้อมูลดังต่อไปนี้จากท่านเพื่อที่บริษัทฯ จะสามารถให้บริการภายใต้แอปพลิเคชั่นแก่ท่านได้ (1) ชื่อและนามสกุล (2) วันเดือนปีเกิด (3) เพศ (4) ภูมิลำเนา/ที่อยู่ปัจจุบัน (5) หมายเลขโทรศัพท์มือถือ (6) ข้อมูลการติดต่อกรณีฉุกเฉิน (7) ข้อมูลบัตรประจำตัวประชาชน (8) ข้อมูลบัญชีธนาคารของผู้รับประโยชน์ และ (9) ข้อมูลทางชีวมาตร

ในการนี้ การที่ท่านตกลงสมัครเป็นผู้ใช้บริการ ท่านตกลงที่จะให้ข้อมูลส่วนบุคคลต่าง ๆ นั้นแก่บริษัทฯ เพื่อให้บริษัทฯ ให้บริการภายใต้แอปพลิเคชั่นแก่ท่านได้ หากท่านไม่สามารถให้ข้อมูลส่วนบุคคลดังกล่าวแก่บริษัทฯ ได้ บริษัทฯ อาจไม่สามารถให้บริการภายใต้แอปพลิเคชั่นทั้งหมดหรือบางส่วนได้

1.2 ข้อมูลที่จัดเก็บระหว่างการใช้บริการภายใต้แอปพลิเคชั่น

บริษัทฯ อาจทำการเก็บรวบรวมข้อมูลเกี่ยวกับอุปกรณ์ที่ท่านใช้ในการเข้าถึงบริการของบริษัทฯ โดยข้อมูลรวมถึงการอนุญาตให้เข้าถึงที่บริษัทฯ จะดำเนินการจัดเก็บ มีดังต่อไปนี้

1.2.1 ข้อมูลตำแหน่งที่ตั้ง

เราเก็บข้อมูลตำแหน่งที่ตั้งของท่านในระหว่างที่ท่านกำลังใช้งานแอปพลิเคชั่นเพื่อประโยชน์ในการระบุตำแหน่งที่อยู่ของท่านโดยอัตโนมัติ อย่างไรก็ตาม เราใช้ความพยายามอย่างเต็มที่เพื่อหยุดการเก็บข้อมูลตำแหน่งของท่านในระหว่างที่ท่านไม่ได้ใช้งานแอปพลิเคชั่น ทั้งนี้ ท่านสามารถเลือกที่จะปิดการติดตามข้อมูลตำแน่งที่อยู่ของท่านเป็นการชั่วคราวโดยดำเนินการผ่านอุปกรณ์ที่ท่านใช้รับบริการภายใต้แอปพลิเคชั่นได้เสมอ

อนึ่ง บริษัทฯ จะไม่แบ่งปันหรือเปิดเผยข้อมูลนี้แก่บุคคลที่สามเว้นแต่ได้รับอนุญาตโดยชัดแจ้งจากท่านก่อน หรือเว้นแต่ในกรณีที่บริษัทฯ มีความจำเป็นต้องดำเนินการตามกฎหมาย กฎเกณฑ์ หรือคำสั่งของศาล หน่วยงานราชการ หรือคำสั่งหรือคำร้องขอใด ๆ ที่มีลักษณะเดียวกันซึ่งมีฐานตามกฎหมาย

1.2.2 ข้อมูลอื่น ๆ เกี่ยวกับอุปกรณ์ที่

เมื่อท่านใช้บริการภายใต้แอปพลิเคชั่น Server ของบริษัทฯ จะทำการบันทึกข้อมูลบางอย่างเกี่ยวกับอุปกรณ์ของท่านโดยอัตโนมัติ โดยข้อมูลอื่น ๆ บางอย่างนั้น รวมถึง ยี่ห้ออุปกรณ์ รุ่น รูปแบบของระบบการดำเนินการ ผู้ระบุลักษณะเฉพาะของอุปกรณ์ เครือข่ายแวดล้อมของอุปกรณ์ ไวไฟ (WiFi) สถานะของอุปกรณ์ การระบุอุปกรณ์ต่างประเทศ การระบุผู้ใช้อุปกรณ์ต่างประเทศ ข้อมูลซอฟท์แวร์ของแอปพลิเคชั่น ข้อมูลการจัดเก็บความทรงจำของอุปกรณ์ โดยการอนุญาตให้บริษัทฯ เข้าถึงข้อมูลต่าง ๆ ดังกล่าวจะช่วยให้บริษัทสามารถระบุลักษณะเฉพาะรวมทั้งความชอบของท่านเพื่อที่บริษัทฯ จะสามารถแนะนำบริการหรือผลิตภัณฑ์ที่เหมาะสมแก่ท่านได้ต่อไป

1.2.3 การติดตั้งแอปพลิเคชั่นต่าง ๆ บนอุปกรณ์ของท่าน

เนื่องจากบริษัทฯ ให้บริการทางด้านการเงินผ่านแอปพลิเคชั่น บริษัทฯ มีหน้าที่ตามกฎหมายในการป้องกันการฉ้อโกง การฟอกเงิน และการกระทำความผิดเกี่ยวกับการเงินอื่น ๆ ซึ่งในการดำเนินการดังกล่าวของบริษัทฯ รวมทั้งการดำเนินการเพื่อรักษาความปลอดภัยให้กับเงินลงทุนและบัญชีของท่าน บริษัทฯ มีความจำเป็นต้องจัดเก็บข้อมูลที่เกี่ยวกับแอปพลิเคชั่นต่าง ๆ ที่ติดตั้งบนอุปกรณ์ของท่าน เพื่อที่บริษัทฯ จะสามารถติดตามความเสี่ยงซึ่งอาจเกิดขึ้นจากพฤติกรรมการใช้แอปพลิเคชั่นต่าง ๆ บนอุปกรณ์ของท่าน

1.2.4 ปฏิทิน

การอนุญาตให้เข้าถึงปฏิทินของท่านมีความจำเป็นสำหรับบริษัทฯ ในการเตือนท่านสำหรับกำหนดการชำระคืนเงินกู้

1.2.5 กล้องถ่ายรูป

บริษัทฯ ขอแจ้งให้ท่านทราบว่า เนื่องจากการให้บริการภายใต้แอปพลิเคชั่นเป็นการให้บริการเกี่ยวกับการเงิน ดังนั้น นโยบายการรู้จักลูกค้า (Know Your Customers) จึงเป็นนโยบายสำคัญที่เราต้องปฏิบัติตาม ดังนั้น การอนุญาตให้เราเข้าถึงกล้องถ่ายรูปจะทำให้เราสามารถให้ท่านจัดให้มีข้อมูลที่เราต้องการสำหรับการปฏิบัติตามนโยบายรู้จักลูกค้าได้อย่างสะดวกสบาย โดยการถ่ายหน้าตาของท่านและถ่ายรูปเอกสารต่าง ๆ ที่จำเป็นและเกี่ยวข้องและส่งให้บริษัทฯ โดยการอัพโหลดลงแอปพลิเคชั่น เมื่อท่านใช้บริการสินเชื่อผ่านแอปพลิเคชั่น

2. ความสมบูรณ์และความถูกต้องของข้อมูล

2.1 การให้ข้อมูลที่เป็นจริงและถูกต้อง

ท่านจะต้องให้ข้อมูลซึ่งรวมถึงข้อมูลส่วนบุคคลที่เป็นความจริงและถูกต้องและไม่นำไปสู่ความเข้าใจที่ผิดพลาด นอกจากนี้ ท่านจะต้องคอยตรวจสอบให้ข้อมูลที่ให้มานั้นเป็นปัจจุบันเสมอ โดยท่านจะต้องแจ้งต่อบริษัทฯ ถึงการเปลี่ยนแปลงข้อมูลใด ๆ โดยเร็ว หากมี ในการนี้ บริษัทฯ ขอสงวนสิทธิในการขอเอกสารเพิ่มเติมจากท่านเพื่อการยืนยันความถูกต้องของข้อมูลที่ท่านให้แก่บริษัทฯ

2.2 ความสมัครใจในการให้ข้อมูลส่วนบุคคล

บริษัทฯ จะสามารถเก็บรวบรวมข้อมูลส่วนบุคคลของท่านได้ก็ต่อเมื่อท่านสมัครใจให้ข้อมูลส่วนบุคคลของท่านแก่บริษัท โดยข้อมูลบางอย่างที่บริษัทฯ ขอให้ท่านนำส่งให้บริษัทฯ นั้น เป็นข้อมูลที่มีความจำเป็นสำหรับบริษัทฯ ในการให้บริการแก่ท่านผ่านทางแอปพลิเคชั่น ในการนี้ หากท่านเลือกที่จะไม่ให้ข้อมูลใดแก่บริษัทฯ หรือหากท่านเพิกถอนความยินยอมในการให้บริษัทฯ เก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลใด ๆ บริษัทฯ ขอเรียนให้ทราบว่าบริษัทฯ อาจะไม่สามารถให้บริการบางอย่างหรือบริการทั้งหมด (แล้วแต่กรณี) แก่ท่านผ่านแอปพลิเคชั่นได้

3. การเปิดเผยข้อมูลส่วนบุคคลต่อบุคคลที่สาม

บริษัทฯ อาจเปิดเผยข้อมูลส่วนบุคคลของท่านต่อบุคคลที่สามเฉพาะในกรณีดังต่อไปนี้ โดยการเปิดเผยจะเป็นไปตามข้อกำหนดภายใต้พระราชบัญญัติการคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 (“พ.ร.บ. คุ้มครองข้อมูลส่วนบุคคล”)

· การเปิดเผยข้อมูลต่อบริษัทในเครือของบริษัทฯ คู่ค้าทางธุรกิจของบริษัทฯ และ/หรือบุคคลที่สามซึ่งเกี่ยวข้องกับบริษัทฯ รวมทั้ง กรรมการ ผู้บริหาร ลูกจ้าง พนักงาน ตัวแทน ที่ปรึกษา ของบริษัทฯ หรือของบริษัทในเครือหรือคู่ค้าทางธุรกิจของบริษัทฯ

· การเปิดเผยข้อมูลต่อสถาบันบุคคลที่สามผู้ให้ความร่วมมือกับบริษัทฯ ซึ่งรวมถึง ผู้ให้กู้ ผู้ให้ความร่วมมือสำหรับการชำระเงิน คู่ค้าหลังการกู้ยืมเงิน ผู้ให้บริการยืนยันตัวตน ผู้ให้บริการข้อความ ผู้ให้บริการทวงถามชำระหนี้ ทั้งนี้ เพื่อเป็นการให้บริษัทฯ สามารถให้บริการและช่วยเหลือท่านในการรับบริการสินเชื่อได้อย่างครบถ้วน

· การเปิดเผยเพื่อให้ท่านสามารถแลกเปลี่ยน และ/หรือใช้บริการได้ตามที่ท่านประสงค์

· การเปิดเผยต่อเครดิตบูโร (หน่วยงานสำหรับการรายงานข้อมูลเครดิตประเภทหนึ่ง)

· การเปิดเผยต่อตำรวจ พนักงานอัยการ ศาล หรือหน่วยงานราชการใด ๆ เพื่อปฏิบัติตามข้อกำหนดภายใต้กฎหมาย กฎเกณฑ์ หรือคำสั่งที่ออกโดยหน่วยงานหรือบุคคลดังกล่าว หรือตามที่ต้องดำเนินการภายใต้กระบวนการสืบสวนสอบสวนตามกฎหมาย หรือการดำเนินการใด ๆ ภายใต้กฎหมายที่เกี่ยวข้อง

4. วัตถุประสงค์ในการเก็บรวบรวม การใช้ และการเปิดเผยข้อมูลส่วนบุคคล (“การประมวลผล”)

ในเบื้องต้น บริษัทฯ จะทำการประมวลผลข้อมูลส่วนบุคคลตามที่จำเป็นเพื่อการให้บริการหรือจัดให้มีผลิตภัณฑ์แก่ท่านตามที่ท่านร้องขอ นอกจากนี้ บริษัทฯ อาจประมวลผลข้อมูลส่วนบุคคลของท่านเมื่อมีเหตุอื่นใดตามกฎหมาย ซึ่งรวมถึง เมื่อบริษัทฯ ต้องทำการประมวลผลเนื่องจากมีหน้าที่ต้องทำตามกฎหมายหรือประโยชน์สาธารณะ หรือเพื่อดำเนินการตามสัญญาที่บริษัทฯ เข้าทำกับท่าน หรือเพื่อประโยชน์โดยชอบด้วยกฎหมายของบริษัทฯ หรือเป็นการดำเนินการตามความยินยอมของท่าน รวมทั้งการดำเนินการบนฐานอื่น ๆ ที่ชอบด้วยกฎหมาย

ข้อมูลส่วนบุคคลของท่านจะถูกประมวลผลตามวัตถุประสงค์ดังต่อไปนี้

4.1 หน้าที่ตามกฎหมายของบริษัทฯ

บริษัทฯ อาจต้องประมวลผลข้อมูลส่วนบุคคลของท่านเพื่อดำเนินการตามกฎหมายและกฎระเบียบที่เกี่ยวข้อง ซึ่งรวมถึงแต่ไม่จำกัดเพียงกรณีดังต่อไปนี้

ก) เพื่อปฏิบัติตาม พ.ร.บ. คุ้มครองข้อมูลส่วนบุคคล รวมทั้งที่ได้แก้ไขเพิ่มเติม

ข) เพื่อปฏิบัติตามกฎหมายที่เกี่ยวข้อง (เช่น กฎหมายธุรกิจสถาบันการเงิน กฎหมายป้องกันและปราบปรามการฟอกเงิน กฎหมายป้องกันและปราบปรามการสนับสนุนทางการเงินแก่การก่อการร้าย กฎหมายว่าด้วยการบัญชี กฎหมายภาษี หรือกฎหมายอื่นที่บริษัทฯ ต้องปฏิบัติตาม) ซึ่งรวมถึง การดำเนินการยืนยันตัวตนผู้รับบริการ การตรวจสอบประวัติและเครดิตของผู้รับบริการ การทำความรู้จักลูกค้า (Know Your Customer) การตรวจสอบเพื่อทราบข้อเท็จจริงเกี่ยวกับลูกค้า (Customer Due Diligence) และการตรวจสอบอื่น ๆ เช่น การตรวจสอบจากฐานข้อมูลสาธารณะของหน่วยงานกำกับดูแล และ/หรือ ข้การดำเนินการตามกระบวนการทางกฎหมายที่บริษัทฯ ต้องปฏิบัติตาม และ/หรือ

ค) เพื่อปฏิบัติตามกฎเกณฑ์ หรือ คำสั่งของหน่วยงานราชการ เช่น คำสั่งศาล

4.2 การปฏิบัติตามสัญญา

บริษัทฯ จะต้องประมวลผลข้อมูลส่วนบุคคลของท่านเพื่อทำตามหน้าที่ของบริษัทฯ ภายใต้สัญญาที่ทำกับท่าน เช่น การให้บริการตามที่ท่านร้องขอ โดยการประมวลผลข้อมูลส่วนบุคคลรวมถึงแต่ไม่จำกัดเพียงการดำเนินการเพื่อวัตถุประสงค์ดังต่อไปนี้

· เพื่อการยืนยันตัวตนผู้ใช้บริการ

· เพื่อการติดต่อผู้ใช้บริการเกี่ยวกับบัญชีของผู้ใช่ หรือเพื่อขอข้อมูล

· เพื่อการดำเนินการสมัครบัญชีผู้ใช้ รวมทั้งการตัดสินใจหรือให้ความช่วยเหลือในการตัดสินใจสำหรับการการคัดกรองผู้ลงทุน ผู้กู้ การลงทะเบียน หรือใบสมัครขอสินเชื่อ และ/หรือเพื่อส่งมอบผลิตภัณฑ์และ/หรือการบริการให้แก่ผู้ใช้งาน และวัตถุประสงค์อื่นที่เกี่ยวข้องโดยตรง

· เพื่อให้ความสะดวกในการดำเนินการเกี่ยวกับสินเชื่อภายใต้แอปพลิเคชั่น ตรวจสอบ ติดตาม การเก็บเงิน และกระบวนการเยียวยาอื่น ๆ

· เพื่อการโต้ตอบกับผู้ใช้บริการ ผ่านอีเมล์ ข้อความสั้น (SMS) การสื่อสารภายในแอปพลิเคชั่น ไปรษณีย์ตอบรับ โทรศัพท์ หรือการลงพื้นที่

· เพื่อแก้ไขปัญหาตามข้อร้องเรียน และดำเนินการตามคำร้องขอ และตอบคำถามผู้ใช้บริการ

· เพื่อค้นหาตำแน่งที่อยู่ของผู้ใช้บริการ

4.3 การจำเป็นเพื่อประโยชน์โดยชอบด้วยกฎหมายของบริษัทฯ

ในบางกรณี บริษัทฯ อาจต้องประมวลผลข้อมูลส่วนบุคคลของท่านเนื่องจากมีความจำเป็นต้องดำเนินการเพื่อประโยชน์โดยชอบด้วยกฎหมายของบริษัทฯ ซึ่งรวมถึงแต่ไม่จำกัดเพียง

· เพื่อจัดเก็บบันทึกภายในของบริษัทฯ เกี่ยวกับข้อมูลที่เกี่ยวข้องกับการใช้บริการโดยผู้ใช้บริการ ซึ่งรวมถึง ข้อมูลสินเชื่อที่ผู้ใช้บริการได้รับ ข้อมูลการชำระคืนเงินกู้ หลักประกันความปลอดภัยสำหรับบริษัทฯ เพื่อความสะดวกในการให้บริการแก่ผู้ใช้บริการ

· เพื่อตรวจสอบประวัติและยืนยันตัวตน รวมถึงการดำเนินการเพื่อการรู้จักลูกค้า

· เพื่อติดตาม ตรวจสอบ วิเคราะห์ และป้องกันการกระทำการฉ้อโกง หรือการกระทำความผิดเกี่ยวกับการเงินใด ๆ

· เพื่อการค้นหาข้อมูลสำหรับการสอบสวนอันเกี่ยวข้องกับข้อพิพาท การชำระเงิน การกระทำซึ่งสงสัยว่าจะเป็นความผิด หรือเป็นการฉ้อโกง

· เพื่อการพัฒนา กระตุ้น และดำรงไว้ซึ่งกระบวนการประเมินความเสี่ยง รวมทั้ง รูปแบบการดำเนินการ ซึ่งรวมทั้งออนไลน์และออฟไลน์

· เพื่อพัฒนาและสร้างคะแนนเครดิต รูปแบบเครดิต และรูปแบบผู้ใช้บริการ

· เพื่ออำนวยความสะดวก (หรือในบางกรณีจำเป็นต้องดำเนินการ) ในการระดมทุน (ได้แก่ จัดหาเงินกู้ หลักประกัน การจำนอง การโอนสิทธิเรียกร้อง การโอนสิทธิเรียกร้องเพื่อเป็นหลักประกัน)

· เพื่อควบคุมหรือบันทึกการสนทนาทางโทรศัทพ์และการโต้ตอบกับลูกค้าต่อหน้า เพื่อการควบคุมคุณภาพการให้บริการ การเทรนพนักงาน การประเมินการปฏิบัติหน้าที่ของพนักงาน และการยืนยันตัวจน

· เพื่อการใช้งาน การตรวจสอบ การจัดการ และการวิเคราะห์แอปพลิเคชั่น และเพื่อพัฒนา กระตุ้น และอัพเกรดลักษณะการใช้งาน (Features) ฟังก์ชั่น ผลิตภัณฑ์ และบริการในแอปพลิเคชั่น รวมถึง การส่งเสริมการขาย โปรแกรมความสม่ำเสมอ และรางวัล

· เพื่อจัดทำการวิจัยทางการตลาดเพื่อให้แอปพลิเคชั่นสามารถเข้าใจและ/หรือระบุ ที่อยู่ลูกค้า ความต้องการของลูกค้า และสถิติจำนวนลูกค้า เพื่อการพัฒนาข้อเสนอพิเศษ ผลิตภัณฑ์ หรือกิจกรรมส่งเสริมการขาย อันเกี่ยวข้องกับผลิตภัณฑ์และบริการที่ให้ผ่านแอปพลิเคชั่น แลเพื่อการพัฒนาผลิตภัณฑ์และบริการดังกล่าว (ซึ่งรวมถึงการทำให้เป็นไปตามความต้องการของลูกค้าโดยเฉพาะเจาะจง)

· เพื่ออำนวยความสะดวกในการทำธุรกรรมเกี่ยวกับธุรกิจหรือทรัพย์สินของบริษัท (ซึ่งอาจครอบคลุมถึง การควบรวมกิจการ การซื้อกิจการ หรือการขายทรัพย์สิน)

· เพื่อการดำเนินการตามวัตถุประสงค์ตามกฎหมาย (รวมถึงแต่ไม่จำกัดเพียงการขอคำแนะนำทางกฎหมายและการระงับข้อพิพาท) และเพื่อดำเนินการตามหน้าที่ทางปกครอง การปฏิบัติการและหน้าที่ตามกฎหมาย

4.4 ความยินยอมของท่าน

ในบางกรณี บริษัทฯ อาจประมวลผลข้อมูลส่วนบุคคลของท่านตามที่ท่านได้ให้ความยินยอมแก่บริษัทฯ ในการดำเนินการ เพื่อประโยชน์ของตัวท่านเอง และ/หรือเพื่อให้บริษัทฯ สามารถให้บริการแก่ท่านได้ตามที่เหมาะสมกับสิ่งที่ท่านต้องการ โดยจะรวมถึงแต่ไม่จำกัดเพียงกรณีดังต่อไปนี้

· ในกรณีที่มีความจำเป็นต้องประมวลผลข้อมูลส่วนบุคคลอ่อนไหว (sensitive personal data) (เช่น ใช้ภาพถ่ายบัตรประจำตัวประชาชนของท่าน (ซึ่งในบัตรดังกล่าวจะมีข้อมูลส่วนบุคคลอ่อนไหวของท่าน ได้แก่ ศาสนา และ/หรือ กรุ๊ปเลือดอยู่) และประวัติอาชญากรรม ในการพิสูจน์และยืนยันตัวตนของท่านก่อนการทำธุรกรรมและการดำเนินการทำความรู้จักลูกค้า (Know Your Customer))

· เพื่อทำการตลาดและให้ข้อเสนอ สำหรับผลิตภัณฑ์หรือบริการใหม่ ผลิตภัณฑ์หรือบริการที่เกี่ยวข้อง หรือผลิตภัณฑ์หรือบริการสมนาคุณ แก่ผู้ใช้บริการ

· เพื่อทำกิจกรรมการตลาดและกิจกรรมส่งเสริมการขายอันเกี่ยวข้องกับบริษัทฯ บริษัทในเครือของบริษัท คู่ค้าของบริษัท รวมทั้งเกี่ยวกับผลิตภัณฑ์หรือบริการอื่น ๆ ของบริษัทฯ ไม่ว่าจะโดยทางอิเล็กทรอนิกส์ อีเมล์ ไปรษณีย์ โทรศัพท์ ข้อความสั้น (SMS) หรือช่องทางโซเชียลมีเดีย หรือโดยการส่งจดหมายข่าว (Newsletters) (เช่น เพื่อให้ผู้ใช้บริการได้รับทราบถึงผลิตภัณฑ์หรือบริการใหม่ เพื่อประกาศงานอีเวนท์ การประกวด โปรแกรมความสม่ำเสมอ การอธิบายต่ง ๆ และกิจกรรมอื่นใดที่จัดขึ้นโดยบริษัทฯ) รวมทั้งการดำเนินการด้วยวิธีการอัตโนมัติด้วย โดยการดำเนินการดังกล่าวจะเกี่ยวข้องกับผลิตภัณฑ์และบริการทางการเงิน และอื่นๆ ที่เกี่ยวข้องซึ่งมีลักษณะเช่นเดียวกัน

· เพื่อนำผู้ใช้บริการเข้าร่วมกลุ่มเครดิต และ/หรือประกันชีวิต การวิเคราะห์ความเสี่ย การให้คะแนนเครดิต การตรวจสอบเครดิต และการจัดเก็บเครดิต

· ส่งหรือโอนข้อมูลส่วนบุคคลและข้อมูลส่วนบุคคลอ่อนไหว (sensitive personal data) ของท่านไปยังต่างประเทศ ซึ่งอาจมีมาตรฐานในการคุ้มครองข้อมูลส่วนบุคคลที่ไม่เพียงพอ (เว้นแต่เป็นกรณีที่ พ.ร.บ.ข้อมูลส่วนบุคคลกำหนดให้สามารถดำเนินการได้ภายใต้ฐานทางกฎหมายอื่น ๆ หรือโดยไม่ต้องได้รับความยินยอม)

4.5 ฐานทางกฎหมายอื่น ๆ

นอกเหนือไปจากฐานทางกฎหมายข้างต้น บริษัทฯ อาจประมวลผลข้อมูลส่วนบุคคลของท่านภายใต้ฐานทางกฎหมายอื่นดังต่อไปนี้

· เพื่อให้ข้อมูลต่อบุคคลภายนอก เช่น หน่วยงานของรัฐ หรือสถาบันอื่น ๆ อันเป็นส่วนหนึ่งของการทำวิจัยหรือการศึกษาทางวิทยาศาสตร์

5. การเก็บรักษาข้อมูลส่วนบุคคล

ข้อมูลส่วนบุคคลที่เก็บรวบรวมโดยบริษัทฯ จะไม่ถูกเก็บไว้อย่างถาวร บริษัทฯ จะเก็บรักษาข้อมูลส่วนบุคคลของท่านไว้เฉพาะระหว่างที่ท่านยังคงเป็นลูกค้าของบริษัทฯ หรือตราบเท่าที่บริษัทฯ จำเป็นต้องดำเนินการตามกฎหมาย หรือจำเป็นต้องเก็บไว้เพื่อให้บรรลุวัตถุประสงค์ของการดำเนินการ เมื่อท่านหยุดการเป็นลูกค้าของบริษัทฯ หรือข้อมูลนั้นไม่มีความจำเป็นต่อการดำเนินการตามวัตถุประสงค์แล้ว หรือเมื่อการเก็บรักษาข้อมูลนั้นเกินกว่าระยะเวลาการเก็บรักษา บริษัทฯ จะทำการลบข้อมูลส่วนบุคคลของท่านจากฐานข้อมูลของบริษัทฯ และ/หรือทำลายข้อมูลส่วนบุคคลของท่าน (แล้วแต่กรณี)

นอกจากนี้ บริษัทจะเก็บรักษาข้อมูลส่วนบุคคลของท่านตามระยะเวลาภายใต้กำหนดอายุความตามกฎหมาย หรือระยะเวลาที่กฎหมายที่เกี่ยวข้องกำหนด หากท่านต้องการลบข้อมูลของท่านโดยทันที ท่านจะต้องแจ้งศูนย์บริการลูกค้าของเราที่ email: Help@cherrybk.com

6. ข้อมูลทางชีวมาตร

6.1 เราเก็บบันทึกข้อมูลใบหน้าของท่านโดยขอให้ท่านถ่ายรูปหน้าของท่าน ระหว่างขั้นตอนการจดจำใบหน้าและจะใช้และประมวลข้อมูลดังกล่าวเพื่อวัตถุประสงค์ดังนี้

· เพื่อยืนยันตัวตนของท่าน

· เพื่อพิสูจน์ว่าท่านยื่นใบสมัครด้วยตนเองในขณะที่ยื่นใบสมัครหรือเวลาอื่นๆ รวมถึงเมื่อมีข้อพิพาทเกิดขึ้นจากการกู้ยืม และ

· เพื่อป้องกันการฉ้อโกงการกู้ยืมเงิน

6.2 ข้อมูลดังกล่าวจะถูกอัพโหลดเข้าสู่ Server ของเรา www.cherrybk.com.เราจะเก็บรูปถ่ายใบหน้าของท่านจนกว่าท่านจะคือเงินกู้ยืมหรือจำนวนอื่นๆ ครบถ้วน (ถ้ามี) หรือระยะเวลานานกว่านั้นตามที่กฎหมายกำหนด เช่น กำหนดอายุความ เป็นต้น หากท่านต้องการลบข้อมูลของท่านโดยทันที ท่านจะต้องแจ้งศูนย์บริการลูกค้าของเราที่ email: Help@cherrybk.com

6.3 เราจะไม่เปิดเผยข้อมูลนี้ต่อบุคคลที่สาม เว้นแต่จะได้รับความยินยอมโดยชัดแจ้งจากท่าน หรือเป็นกรณีที่เราต้องปฏิบัติตามกฎหมาย คำสั่งของศาล หน่วยงานรัฐ หรือ คำสั่งอื่น ๆ ที่คล้ายคลึงกันภายใต้กฎหมายซึ่งบริษัทฯจะต้องปฏิบัติตาม โดยที่ศาลและหรือหน่วยงานรัฐดังกล่าวนั้นจะเก็บรักษาข้อมูลของท่านตามระยะเวลาที่กำหนดโดยกฎหมายที่เกี่ยวข้อง

7. การรักษาความปลอดภัยของข้อมูลส่วนบุคคล

7.1 บริษัทฯ ให้ความสำคัญกับข้อมูลส่วนบุคคลที่เก็บรวบรวม ใช้ และเก็บรักษาโดยบริษัทฯ บริษัทฯ จึงจัดให้มีมาตรการไม่ว่าจะเป็นทางเทคนิค ทางองค์กร และทางกายภาพ ในการปกป้องข้อมูลส่วนบุคคลที่อยู่ในแอปพลิเคชั่นหรือฐานข้อมูลของบริษัทฯ โดยข้อมูลส่วนบุคคลทั้งหมดที่บริษัทฯ เก็บรวบรวมจะถูกเก็บรักษาไว้ที่ www.cherrybk.com.

7.2 บริษัทฯ เข้าใจถึงความสำคัญในการเก็บรักษาข้อมูลส่วนบุคคลของท่านให้ปลอดภัย เราจึงดำเนินการตามสมควรเพื่อปกป้องข้อมูลส่วนบุคคลของท่านและเพื่อให้เกิดความมั่นใจในระบบรักษาความปลอดภัยของเรา ในการนี้ เพื่อการป้องกันข้อมูลส่วนบุคคลของท่านในการถูกเข้าถึงหรือใช้โดยไม่ได้รับอนุญาต เราจัดให้มีมาตการการรักษาความปลอดภัยเพื่อให้เป็นไปตามกฎหมายที่เกี่ยวข้อง โดยบริษัทฯ ใช้เทคโนโลยีดังต่อไปในการดำเนินการรักษาความปลอดภัยข้อมูลส่วนบุคคลของท่าน

· การตรวจจับการบุกรุก ได้แก่ ระบบซอฟท์แวร์สำหรับการตรวจจับและบล็อคการโจมตีโดยแฮคเกอร์ โดยบริษัทฯ ใช้ระบบซอฟท์แวร์ซึ่งมีประสิทธิภาพสำหรับวัตถุประสงค์ดังกล่าวและจะทำการอัพเดทระบบอย่างสม่ำเสมอ

· ไฟร์วอลล์ (Firewall) ได้แก่ ระบบซอฟท์แวร์ที่อนุญาตให้ลูกจ้างที่ได้รับการมอบหมายจากบริษัทฯ ให้เข้าถึงข้อมูลส่วนบุคคลของท่านได้ โดยบริษัทฯ ใช้ระบบป้องกันโดยไฟร์วอลล์แบบคู่

· การแสกนไวรัส: บริษัทฯ ติดตั้งซอฟท์แวร์ที่มีประสิทธิภาพสำหรับการกำจัดไวรัสไว้ในระบบของบริษัทฯ อย่างสม่ำเสมอ และยังติดตั้งซอฟท์แวร์สำหรับการแสกนไวรัสใน Server ของบริษัทฯ ด้วย

· Secured Socket Layer (การเข้ารหัสข้อมูลที่เป็นมาตรฐานความปลอดภัยที่น่าเชื่อถือที่สุด) คือ เทคโนโลยีการเข้ารหัสข้อมูล เพื่อเพิ่มความปลอดภัยในการสื่อสารหรือส่งข้อมูลบนเครือข่ายอินเทอร์เน็ต ระหว่างเครื่องเซิร์ฟเวอร์กับเว็บเบราว์เซอร์หรือแอปพลิเคที่ใช้งาน โดยเทคโนโลยีนี้จะทำให้ผู้ที่ต้องการเข้าถึงข้อมูลหรือแฮกเกอร์ ไม่สามารถเข้าใจความหมายของข้อมูลที่พยายามจะเข้าถึงได้ นอกจากนี้ เทคโนโลยีนี้ยังอาจถูกใช้เพื่อยืนยันความมีอยู่ของเว็บไซต์ของบริษัทฯ ซึ่งปัจจุบันใช้ Secured Socket Layer เวอร์ชั่น 128-bit (SSL.1 สำหรับการส่งข้อมูล)

· การทำข้อมูลให้เป็นรหัสลับ (Data encryption): เทคโนโลยีนี้จะนำไปใช้กับข้อมูลส่วนบุคคลอ่อนไหว (Sensitive Personal Data) โดยก่อนที่จะนำข้อมูลเข้าสู่ฐานข้อมูลในคอมพิวเตอร์ของบริษัทฯ บริษัทฯ จะใช้ ชุดของคำสั่งที่สร้างไว้ (algorithm) ที่มีความซับซ้อนเพื่อดำเนินการให้ข้อมูลเป็นรหัสลับ ดังนั้น จะไม่มีบุคคลใด แม้กระทั่งพนักงานของบริษัทที่จะรับรู้ถึงข้อมูลอ่อนไหวนั้นผ่านระบบการจัดเก็บโดยบริษัทฯ

· คุกกี้ (Cookies) ได้แก่ แฟ้มข้อมูลเล็ก ๆ ในคอมพิวเตอร์ที่สามารถจัดเก็บข้อมูลสำคัญเป็นการชั่วคราวในระบบคอมพิวเตอร์เพื่อความสะดวกสำหรับการโทรคมนาคม บริษัทฯ แนะนำให้ท่านใช้คุ้กกี้อย่างระมัดระวัง อย่างไรก็ตาม หากมีกรณีที่มีคุ้กกี้ใดที่จำเป็นต้องใช้ บริษัทฯ จะดำเนินการอย่างระมัดระวังและให้ความสำคัญกับความปลอดภัยและความเป็นส่วนตัวของท่านเป็นลำดับแรก

· การออกจากระบบโดยอัตโนมัติ: หลังจากเสร็จสิ้นการทำธุรกรรมผ่านการใช้บริการของบริษัทฯ แล้ว โปรดอย่าลืมดำเนินการเพื่อออกจากระบบ อย่างไรก็ตาม ในกรณีที่ท่านลืม ระบบจะทำการออกจากระบบให้ท่านโดยอัตโนมัติภายในระยะเวลาที่เหมาะสมเพื่อรักษาความปลอดภัยให้แก่ท่าน

7.3 ถึงแม้บริษัทฯ จะใช้ความพยายามอย่างดีและดำเนินการอย่างซื่อสัตย์ในการเก็บรักษาข้อมูลส่วนบุคคลของท่านที่เก็บรวบรวมผ่านแอปพลิเคชั่นให้อยู่ในสภาพแวดล้อมที่มีความปลอดภัยและไม่สามารถเข้าถึงได้โดยทั่วไป บริษัทฯ ไม่อาจรับประกันความปลอดภัยของข้อมูลส่วนบุคคลของท่านได้อย่างเด็ดขาดในระหว่างที่มีการส่งข้อมูลหรือระหว่างที่ข้อมูลถูกเก็บรักษาในระบบของบริษัทฯ นอกจากนี้ ขณะที่บริษัทฯ ใช้ความพยายามอย่างเต็มที่ในการจัดให้มีระบบที่มีความปลอดภัย บริษัทฯ ไม่สามารถรับประกันได้ว่ามาตรการความปลอดภัยของบริษัทจะสามารถป้องกันแฮกเกอร์จากการเข้าถึงข้อมูลโดยผิดกฎหมาย บริษัทฯ ไม่ให้คำรับรองหรือรับประกันว่าข้อมูลของท่านจะได้รับการปกป้องจากความเสียหาย การใช้ในทางที่ผิด หรือการแก้ไขโดยบุคคลที่สามอื่นใดโดยไม่ได้รับอนุญาต แต่อย่างใด

8. หน้าที่ของผู้ใช้บริการและสิทธิของบริษัทฯ

ท่านตกลงว่าท่านจะแจ้งให้บริษัททราบเป็นลายลักษณ์อักษรโดยเร็ว โดยไม่ว่าในกรณีใดก็ตามไม่เกิน 14 วัน ในกรณีที่มีการเปลี่ยนแปลงข้อมูลใด ๆ ที่ท่านให้ไว้แก่บริษัทฯ และจะทำการโต้ตอบโดยเร็วหากบริษัทฯ ขอข้อมูลใด ๆ จากท่าน

8.1 ในกรณที่

8.1.1 ท่านไม่ดำเนินการให้ข้อมูลผู้ใช้งานหรือข้อมูลส่วนบุคคลตามที่บริษัทฯ ร้องขอโดยมีเหตุอันสมควร

8.1.2 ท่านไม่ให้หรือเพิกถาความยินยอมที่บริษัทฯ ต้องการสำหรับการประมวลผลข้อมูลส่วนบุคคลของท่านตามที่ระบุไว้ข้างต้น (ทั้งนี้ เว้นแต่กรณีที่วัตถุประสงค์ของการประมวลผลนั้นเกี่ยวข้องกับการตลาดของบริษัทฯ หรือการส่งเสริมการขายผลิตภัณฑ์หรือบริการ) และ/หรือ

8.1.3 บริษัทฯ หรือบุคคลที่เกี่ยวข้องกับบริษัทฯ มีข้อสงสัยเกี่ยวกับการกระทำความผิดเกี่ยวกับการเงิน หรือความเสี่ยงอื่นใดที่เกี่ยวข้อง

8.2 บริษัทฯ อาจ

8.2.1 ไม่สามารถให้บริการให้บริการตามที่บริษัทฯ กำลังดำเนินการอยู่ หรือบริการใหม่ ไม่ว่าทั้งหมดหรือบางส่วน แก่ท่านได้ และบริษัทฯ ขอสงวนสิทธิในการยุติความสัมพันธ์กับท่าน (ในกรณีที่จำเป็น)

8.2.2 ดำเนินการตามที่จำเป็นสำหรับบริษัทฯ หรือบุคคลที่เกี่ยวข้องกับบริษัทฯ เพื่อการปฏิบัติหน้าที่ตามกฎหมาย และฝหรือ

8.2.3 ระงับ โอน หรือปิดบัญชีของท่าน ตามที่สามารถดำเนินการได้ภายใต้กฎหมายไทย

9. สิทธิตามกฎหมายของท่าน

พ.ร.บ. คุ้มครองข้อมูลส่วนบุคคล ให้สิทธิบางประการแก่ท่านเกี่ยวกับข้อมูลส่วนบุคคลของท่านซึ่งท่านอาจใช้สิทธิต่าง ๆ ดังกล่าวผ่านช่องทางของบริษัทฯ ที่ระบุไว้ในนโยบายนี้ สิทธิต่าง ๆ ดังกล่าวรวมถึง

9.1 สิทธิในการเข้าถึงและขอรับสำเนาข้อมูลส่วนบุคคลของท่านที่อยู่ในความครอบครองของบริษัทฯ

ท่านมีสิทธิขอให้บริษัทฯ ให้ท่านเข้าถึงและ/หรือทำสำเนาข้อมูลส่วนบุคคลของท่านที่บริษัทมีอยู่ เว้นแต่กรณีที่การดำเนินการดังกล่าวอาจส่งผลกระทบต่อหรือทำให้เกิดความเสียหายต่อสิทธิหรือเสรีภาพของบุคคลอื่น ซึ่งบริษัทมีสิทธิปฏิเสธคำขอของท่าน นอกจากนี้ บริษัทฯ อาจปฏิเสธคำขอของท่านหากมีเหตุตามกฎหมายหรือคำสั่งศาล

9.2 สิทธิในการขอถอนความยินยอม

ท่านมีสิทธิขอถอนความยินยอมเกี่ยวกับข้อมูลส่วนบุคคลของท่านที่ท่านได้ให้ไว้กับบริษัทเมื่อใดก็ได้ ตามขั้นตอนและวิธีการที่บริษัทกำหนด เว้นแต่โดยสภาพไม่สามารถถอนความยินยอมได้ การถอนความยินยอมของท่านจะไม่ส่งผลกระทบต่อการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของท่านที่ได้ให้ความยินยอมไปแล้วโดยชอบ ก่อนการถอนความยินยอมดังกล่าว และจะไม่ส่งผลกระทบต่อบริการที่บริษัทฯ ให้แก่ท่าน เว้นแต่เป็นการบริการที่จำเป็นต้องประมวลผลข้อมูลส่วนบุคคลที่ต้องได้รับความยินยอมจากท่านก่อน

9.3 สิทธิในการขอแก้ไข และ/หรือลบข้อมูลส่วนบุคคลของท่าน

ท่านมีสิทธิขอให้บริษัทฯ ทำการแก้ไข หรือปรับปรุงข้อมูลส่วนบุคคลของท่านที่ไม่ถูกต้องหรือไม่ครบถ้วน รวมทั้งมีสิทธิขอให้บริษัทฯ ลบหรือทำลายข้อมูลของท่าน หรือทำให้ข้อมูลของท่านเป็นข้อมูลที่ไม่สามารถระบุตัวตนของท่านได้ เว้นแต่กรณีที่บริษัทจะมีเหตุอันชอบด้วยกฎหมายในการปฏิเสธคำขอของท่าน ทั้งนี้ บริษัทฯ จะไม่อ้างว่าการแก้ไขปรับปรุง การลบ หรือการทำให้ข้อมูลเป็นข้อมูลที่ไม่สามารถระบุตัวตนได้นั้นทำให้บริษัทฯ ไม่สามารถปฏิบัติหน้าที่ที่บริษัทฯ มีต่อท่านภายใต้ความสัมพันธ์ตามกฎหมายระหว่างบริษัทฯ และท่านแต่อย่างใด

ท่านมีสิทธิขอให้บริษัทฯ ระงับการใช้ข้อมูลส่วนบุคคลของท่านในบางกรณีโดยไม่ลบหรือทำลายข้อมูลของท่านออกจากฐานข้อมูลของบริษัทฯ เช่น ในกรณีที่ท่านมีความจำเป็นต้องขอให้เก็บรักษาข้อมูลส่วนบุคคลของท่านไว้เพื่อใช้ในการก่อตั้งสิทธิเรียกร้องตามกฎหมาย หรือการปฏิบัติตามหรือการใช้สิทธิเรียกร้องตามกฎหมายหรือการยกขึ้นต่อสู้เพื่อสิทธิตามกฎหมาย แต่ท่านไม่ต้องการให้บริษัทฯ ใช้ข้อมูลส่วนบุคคลของท่านอีกต่อไป

9.5 สิทธิในการคัดค้านการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของท่าน

ท่านมีสิทธิคัดค้านการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของท่านในกรณีที่บริษัทดำเนินการภายใต้ฐานประโยชน์โดยชอบด้วยกฎหมาย หรือเพื่อวัตถุประสงค์เกี่ยวกับการตลาดแบบตรงหรือการศึกษาวิจัยทางวิทยาศาสตร์ ประวัติศาสตร์ หรือสถิติ เว้นแต่กรณีที่บริษัทมีเหตุในการปฏิเสธคำขอของท่านโดยชอบด้วยกฎหมาย

9.6 สิทธิในการขอรับหรือขอให้ส่งหรือโอนข้อมูลส่วนบุคคลของท่าน

9.7 สิทธิในการร้องเรียน

ท่านมีสิทธิร้องเรียนต่อเจ้าหน้าที่คุ้มครองข้อมูลส่วนบุคคลของบริษัทฯ รวมทั้งมีสิทธิยื่นคำร้องต่อคณะกรรมการคุ้มครองข้อมูลส่วนบุคคลหรือสำนักงานคณะกรรมการคุ้มครองข้อมูลส่วนบุคคล หากบริษัทฯ กระทำการอันเป็นการที่ไม่เป็นไปตามหรือขัดแย้งกับ พ.ร.บ.คุ้มครองข้อมูลส่วนบุคคล

10. การแก้ไขเพิ่มเติม

นโยบายนี้อาจได้รับการแก้ไขเพิ่มเติมเป็นครั้งคราว โดยหากไม่มีการแก้ไขเกิดขึ้นนโยบายนี้จะยังมีผลบังคับใช้อยู่ต่อไป ทั้งนี้ หากมีการเปลี่ยนแปลงนโยบายนี้ บริษัทฯ จะประกาศการเปลี่ยนแปลงลงบนแอปพลิเคชั่นและการเปลี่ยนแปลงนั้นจะมีผลบังคับเมื่อมีการประกาศนั้น ดังนี้ บริษัทฯ แนะนำให้ท่านผู้ใช้บริการรวมทั้งผู้เข้าเยี่ยมชมแอปพลิเคชั่นทำการตรวจสอบแอปพลิเคชั่นอย่างสม่ำเสมอ เพื่อที่ท่านจะได้ทราบถึงนโยบายและการปฏิบัติต่อวิธีการเก็บรวบรวม และใช้ ข้อมูล

ในกรณีการเปลี่ยนแปลงนโยบายอย่างมีสาระสำคัญจะกระทบถึงข้อมูลส่วนบุคคล แอปพลิเคชั่นจะแจ้งให้กับผู้ใช้บริการทราบทางอีเมล์ที่ได้ให้ไว้ หรือประกาศผ่านทางแอปพลิเคชั่น

การให้ความยินยอมและการอนุญาตใด ๆ จะมีผลอยู่ตลอดระยะเวลาที่มีผลบังคับใช้ของสัญญากู้ยืม หรือสัญญาใด ๆ ที่เกี่ยวข้องที่ทำขึ้นระหว่างท่านและบริษัทฯ หรือธุรกรรม หรือการตกลงใด ๆ หรือบัญชีใด ๆ ที่ท่านจัดทำหรือได้รับจากการใช้แอปพลิเคชั่นหรือผู้ให้กู้ผ่านการบริการภายใต้แอปพลิเคชั่น และจะมีผลบังคับต่อไปหลังการสิ้นสุดสัญญา ธุรกรรม ข้อตกลง หรือบัญชีนั้น
